However, we cannot guarantee the accuracy, precision or exhaustiveness of all the information on our website, which is why we do not accept any responsibility resulting from fraudulent intrusion by a third party leading to an amendment of the information made available on the website and more generally for any damage, direct or indirect, whatever the cause, origin, nature or consequences, caused by the access of any person to the website or the lack of access to it, the use of the website and/or any credit given to any information gained directly or indirectly from it.

These general terms and conditions of sale exclusively govern the sale of products offered on our website. They are systematically available on this website to the purchaser at the time of ordering. Consequently, placing an order implies the purchaser’s full and unreserved acceptance of these general terms and conditions of sale. Any contrary condition put forth by the purchaser shall, therefore, unless explicitly accepted by us, be non-invocable to the seller, regardless of the time at which it may have been brought to the seller’s attention. The fact that the seller does not exercise one or more of the provisions of these general terms and conditions of sale shall not be interpreted as a waiver of the right to prevail at a later date of any of the said conditions.

Prior to placing an order, the Purchaser declares that he/she has the full legal capacity to commit to these terms and conditions of sale.

In accordance with the provisions of Articles 1316 to 1316-4 of the Civil Code, and Decree no. 2001-272 of 30 March 2001, in pursuance of the application of Article 1316-4 of the Civil Code and relating to the electronic signature, it is reminded that the validation of the order form as specified in Article 3 below, constitutes an electronic signature which has the same value as a handwritten signature between the Parties.

GAULT Parfums reserves the right to amend these general terms and conditions of sale at any time. In this case, the applicable conditions will be those in effect on the date of the Purchaser’s order.  

2. PRODUCTS AND PRICES

In accordance with Article L. 111-1 of the Consumer Code, the User can, prior to ordering, peruse the Gault Parfums website for the key features of the product(s) he/she wishes to order. Promotional offers are valid within the confines of the validity of the offer concerned and available stock.

The sale prices of the products on our Website, indicated in euros, including all taxes, are those in force at the time the Purchaser places his/her order. The prices do not include delivery costs, which are charged in addition to the price of the products purchased, depending on the amount of the order and the destination country. The delivery costs will be indicated before the Purchases places the order.

The selling prices of products can be amended by Gault Parfums at any time. This modification will be indicated to the Buyer before every order.

3. REGISTRATION AND VALIDATION and payment OF THE ORDER

The User can browse the different Products offered for sale by Gault Parfums on its Website. They can freely navigate the Website pages without committing to an order.

Every order implies the acceptance without restriction or reserve of these terms and conditions of sale. The products are fully owned by GAULT Parfums until full payment is received by Gault Parfums.

When you confirm your order by clicking on the “confirm” button, you declare that you accept the order and all of these general terms and conditions of sale fully and without reservation. Your order is then processed so you can receive your package. Immediately after placing your order, you will receive an acknowledgement of receipt to your email address. This acknowledgement of receipt will specify the exact amount invoiced and the delivery terms of your order. This acknowledgement of receipt is equivalent to the acceptance of your order and will validate the transaction.  

We reserve the right to cancel any customer order with whom there is a dispute over payment of a previous order.

Payment must be made at the time the Purchases places the order. At no time may the sums paid be considered a deposit or advance payment.
All orders are payable in euros. The Purchaser guarantees GAULT Parfums that he/she has the necessary permission to use the payment method he or she chooses when placing the order.

GAULT Parfums reserves the right to suspend or cancel any order and/or delivery, whatever its nature or degree of execution, in the event of non-payment of any sum due by the Purchaser, in the event of a payment incident or the event of an existing dispute with the Purchaser.

As part of the fight against Internet fraud, information relating to your order may be to any third party for verification.

The Purchaser may use the following payment methods to pay for his/her order: bank card, bank or postal cheque issued by a French bank, or bank transfer.

– The following bank cards are accepted on the website: Carte Bleue, Visa and Master Card.

Payments made by bank card will be executed through the Stripe system. This uses SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party will have access to it while it is being transferred.
When paying by bank card, the Purchaser’s account will be debited on the day of the order.

– Bank or postal cheques issued by a French bank:

When paying by cheque, the  Purchaser shall make the cheque out to GAULT Parfums. They should put the order number on the reverse of the cheque. They should post this cheque to the following address:  GAULT Parfums – 674 rue Roussanne – 84100 ORANGE

GAULT Parfums will send out the products at the earliest 5 working days after the cheque corresponding to the order has been cashed, subject to provisions.

– Bank transfers:

When paying by bank transfer, the Purchaser shall indicate the order number.
GAULT Parfums will send out the products upon receipt of the funds corresponding to the order.

4. DELIVERY AND RECEIPT

The products will be delivered to the address given by the Buyer on the order form, a destination which must be consistent with the geographical area previously indicated and is understood to be ex-works from Orange 84100.

By default, invoices are sent to the e-mail address given by the Customer at the time of registration.

If the procedures below are not followed no claim by the Purchaser shall be accepted.

Delivery is performed by GLS. If the Purchaser is out, they or the recipient of the product ordered will receive an advice note that the delivery company has attempted to make a delivery and the Purchaser should reschedule the delivery or collect it from a collection point.  

The Purchaser must check the condition of the packaging and the delivery contents in the presence of the postal office employee or delivery person.

If the Purchaser has any concerns whatsoever about the condition or content of the package he/she must express their reservations to the delivery person and report the problem to Gault Parfums at [email protected] within 24 hours, specifying the order number and their name.

Delivery times by GLS, following validation of your order, are 3-5 working days within France, and 5-7 working days for other European countries covered.

Products are offered according to available stock. If a Product is unavailable the Purchaser will be informed as soon as possible.

5. RIGHT OF WITHDRAWAL

In accordance with Article L. 121-20 of the French Consumer Code, the Purchaser has a period of 14 clear days from the date of receipt to return the ordered products for reimbursement at his/her own expense.

Products must be returned to GAULT PARFUMS 674 rue Roussanne 84100 ORANGE, in perfect condition for resale, in their original condition (packaging, accessories, instructions, etc.), duly sealed.

When a purchaser returns products, all risks linked to the return are the responsibility of the purchaser. GAULT Parfums will not accept packages with unpaid postage.

If the above procedure is not followed and the above-mentioned deadlines are not met, the purchaser may not make any claim for any non-conformity or apparent defect of the products delivered, the products being deemed to be in conformity and free of any apparent defect.

6. RESERVATION OF OWNERSHIP

GAULT Parfums retains full ownership of the products sold until full payment is received, including all taxes and fees.

7. RESPONSIBILITY

GAULT Parfums cannot be held responsible for the non-execution of the contract in the event of stock shortage or unavailability of the product due to a case of force majeure, disruption or total or partial strike, in particular of delivery services and transport and/or communications methods. The products offered comply with current French legislation.

GAULT Parfums reminds you that any creation of a hypertext link to this website is subject to the express, prior and written agreement of GAULT Parfums.

If one or more provisions of these general terms and conditions of sale are considered to be invalid or declared as such by law, a regulation or following a final decision of a competent court, the other provisions shall remain in full force and binding.

The fact that one of the parties does not take advantage of a breach by the other party of any of the conditions referred to in these general terms and conditions of sale shall not be interpreted in the future as a waiver of the obligation in question.

In the event of disputes or litigation arising from or in connection with a contract between GAULT Parfums and the Customer, they may be resolved by mediation/conciliation.

In accordance with Law no. 78-17 of 6 January 1978 relating to data processing, files and liberties, the processing of personal information collected on the Website has been declared to the National Commission for Data Processing and Liberties. The User has the right to access, amend, rectify and delete data concerning him/her. To exercise this right, the User should send a postal letter to GAULT Parfums – 674 rue Roussanne – 84100 Orange

8. INTELLECTUAL PROPERTY

All elements of the GAULT Parfums website are the exclusive intellectual property of MAS LA CONFIANCE. No one is authorised to reproduce, exploit, rebroadcast or use for any reason whatsoever, even partially, elements of the website, whether software, visual or audio.

The reproduction or use of all or part of these elements is only authorised for the exclusive purpose of information for personal and private use, with any reproduction and any use of copies made for other purposes being expressly prohibited. Any other use constitutes infringement and is punishable under the Intellectual Property Code unless prior written authorisation is obtained from GAULT Parfums.

9. APPLICABLE LAW AND JURISDICTION

GAULT Parfums’ product sales are subject to French law. This contract is in English.

Any dispute relating to the interpretation, execution or breach of contract between GAULT Parfums and the Purchaser, even in the case of multiple defendants, will, in the absence of an amicable agreement, be under the exclusive jurisdiction of the French courts.
